Under Reconstruction

The transcript is scheduled to be completed on February 2, 2005. A copy will be in my hands on that date and work on the Appeal, which could not be started without it, will commence. Additonal charges are to be filed this week and SSNS Editor Mark S. "Bear" Daniels will meet with Civil Attorneys in Las Vegas by mid-February, 2005, for consultation and discussions. Story and a preview of what's coming.

Further, it was anticipated that the complaint might have to go to Nevada. A coin toss as where to file since the US Attorney would refer to the proper agency in the first place, so if I file in California, which is more convenient for me, and the complaint is filed in the wrong location, the US Attorney will send it to the correct location for consideration. The US Attorneys Office in Los Angeles may have taken some additional time either way, to decide whether to keep it in L.A. or send it to Nevada for local handling there by the US Attorney in Las Vegas.

In General, it would be better to have the complaint handled outside of Nevada over any fear of impartiality or neutrality lacking, however, Nevada has its own investigating force which is closer to where the crimes were committed and the people that committed them, so once again, it becomes a coin toss.

Most importantly, the complaint lives and is in the system, since this is the first confirmation of that fact by the Federal Government; and though the move is a lateral one from L.A. to Las Vegas, it has yet to die for lack of merit.

The next few months should be interesting as the case progresses. SSNS Editor Daniels is still waiting to hear from the Washoe County Court in regards to his Motion for Extension of Time in which to file Opening Briefs, and he is still waiting on a transcript that has been delayled by a number of reasonable and legitimate factors, not the least of which is the issue once again, of the Holidays that have just past.

The transcript of the case has been ordered by Daniels and is in process at this time. Due to the time required to prepare the transcript, the Appellant Daniels believes that an extension of the time will be necessary and will make application tomorrow with the District Court Clerk.

Once the Appellant has his Opening Brief served on the City Attorney's Office, shown as Leanne Kendall, Edq. Deputy City Attorney for Reno, Nevada, the City Attorney's Office will have thirty days to respond to Appellant's Brief. Upon receipt of the City Attorney's (Respondant's) Answering Brief, the Appellant Daniels will have fifteen days to serve and file his Reply Brief.

Judge Connie J. Steinheimer, Department 4, has ordered that once the Briefs have been filed, the Court will take the matter into consideration without oral arguments. Counsel is to file a request for submission of the Appeal to the Court, once the Appeal is ready to be ruled upon.

Daniels was arrested by Michael J. Houghton, President and CEO of the Reno Air Racing Association (RARA), and Air Race Chairman Tom Robinson, who also serves as Deputy Police Chief of Reno, Nevada. In their testimony it was indicated that the "Ten-member Executive Committee" of the Reno Air Racing Association had "voted" to authorize the action.

The ten member Executive Committe includes Tom Gribbin, Frank Kinnell, Brigadier General (ret.) Clayton T. Gadd, Susan Fisher, T.J. Day, Deputy Police Chief Tom Robinson (also a Major, Air National Guard), Joey Scolari, and Mark Bailey. Two others remain unidentified at RARA's own website, www.airrace.org, though one who is shown on RARA Correspondence as "Dick Van Allen" is not listed at the site.

Daniels has demanded the resignations of four of the individuals on the Executive Committee previously, including Gribbon, who is unlawfully on the Board of Directors while simultaneously on the Board of Directors at the Reno Air Racing Foundation (RARF) and the Airport Authority of Washoe County (AAWC). Gribbin's position at RARA and RARF is unlawful due to the fact that Nevada Revised Statutes prohibit a member of the Board of Trustees, AAWC, from serving simultaneously on other boards.

Gribbin is known for prior conflicts of interest in that, while on the Board of the AAWC, his construction company has been involved in bidding for contracts at AAWC.

Daniels has also previously demanded the resignations of General Gadd and Major (Deputy Police Chief) Robinson citing their violation of their sown oaths as U.S. Military Officers, whether retired, active duty or reserve status. The sworn oaths they have taken, which remain in effect all their lives by application of US and Military Law, do not allow either "Officer and Gentleman" to violate the Law, but rather, they are sworn to "uphold the Laws and Constitution of the United States" to their deaths.

In this way, either man can be called to duty in time of National Emergency, and neither man can release Classified information after retiring from the service, leaving the service and/or while being "off duty" inactive. The oaths apply to all Officers, Enlisted Men and Non-commissioned Officers of the U.S. Military.

Finally, Daniels has called for the resignation of Joey Scolari for aiding and abetting the Criminal Misconduct of the Reno Air Racing Association, its Officers and Agents. Daniels is also concerned over the issue of Nepotism beyond conflict of interest, in that, a Brett J. Scolari works for the Law Firm of Jones Vargas, which represents both the AAWC and RARA, and B.J. Scolari has refused to answer questions as to possessing any family relationship with Joey Scolari.

As a result of this latest revelation, Daniels will be filing additional charges against the ten members of the Committee for "Conspiracy Against Rights," and further, will be seeking action from the Inspector General's Office in regards to the one retired General who sits on the Committe, General Gadd, and also, Air National Guard Major Robinson, in regards to Criminal Misconduct by RARA, cover-up of the same, Civil Rights Violations, violating their sworn oaths and Criminal Misconduct on their own parts (i.e., "Conspiracy Against Rights," among other potential charges).

The case involves the arrest of Daniels, Editor of Silver State News Service, for alleged Misdemeanor Trespass at the Reno Air Races on September 14, 2004. Daniels was found guilty during trial on November 15, 2004, in Department Two of Reno Munincipal Court, Judge Hickman presiding.

Daniels has previously cited First Amendment Rights, Jurisdictional issues, along with the failure of Deputy Police Chief Tom Robinson to read him his Miranda Rights, as well as issues surrounding Discovery and lack of evidence upon which to convict, and finally, a new issue brought up by the Judge in regards to alleged Discrimination, i.e., "Enumeration of Rights," which is covered by Amendment IX to the U.S. Constitution (The Bill of Rights).

With four of the major issues (Press, Miranda, Discovery, Enumeration) involving Constitutional Law, it is believed the case will have to be moved to the Federal Courts for handling. Even if the case does not go directly to the Federal Courts, should Daniels' lose his appeal, the appellate process could continue all the way up to the United States Supreme Court.

The two remaining issues involve Jurisdiction, which is still contested, and Discrimination, which is related to the Enumeration of Rights issue.

Daniels previously filed Federal charges in the case and will be filing additional charges shortly. He is currently banned from the Reno Air Races until further notice. The ban was imposed by the ten-member Executive Committee, according to the testimony of RARA Chairman Tom Robinson, who is also head of Security at that organization and a 28-year veteran of the Reno Police Department.

Judge rules against Defense and allows evidence containing Editor's statements made at Stead Airport, though Defendant was not read his Miranda Rights.

RARA's testimony allowed into Court despite refusal of Discovery, no supporting evidence. Reno P.D. ruled to have concurrent jurisdiction over Stead Airport Nevada.

Judge rules against Defendant on intent to organize Union argument. Indicates additionally that Defendant's refusal of Press Credentials do not support First Amendment Defense.

Appeal to be Filed. Progress made in exposing elements of RARA misconduct to Court and City of Reno.

My argument was that the event was advertised from the 16th through the 19th of September and that the event began in that time frame (16th) and ended in that time frame (19th). I argued that the letter of exclusion was discrimination and further, contained no listing of events, accurate dates and times, borders or property information from which to stay away from, and that I was arrested on a free day (September 14th) to the Public on a Public Airport where I conduct business.

Hello again:

As a news reporter of 33 years, I'm investigating Criminal Misconduct on the part of the Reno Air Racing Association (RARA) and its officials, along with the Airport Authority of Washoe County (AAWC), and their officials, all of whom are running Stead Airport, Nevada.

A plot has been discovered ~ a plot by which these individuals are attempting to close down the races, build an industrial park on 3500 acres of race course lands, and possibly move the Air Races to Las Vegas or shut them down. The racecourse lands were sold illegally by AAWC officials in RARA back to AAWC officials at their parent organization, while all were still with the AAWC ~ a violation of Nevada State Law and a glaring Conflict of Interest. In the process, they are attempting to defraud the government of funding and property associated with the Federal Aviation Administration's (FAA) Airport Improvement Grant (AIP) Program.

I also discovered three potential plots to murder individuals on Stead Airport in order for the AAWC and RARA to profit from the deaths. I am allegedly under threat of death myself for my exposing these individuals' crimes.

They are trying to block me from learning more about their scheming, so they had me arrested for "Misdemeanor Trespass." They did not have the authority to arrest me. As a member of the Press, I have Civil Rights under the First Amendment to the Constitution of the United States allowing me Freedom of Press, Freedom of Speech, Freedom of Expression and Freedom of Opinion.

The current Chairman of RARA, one Mr. Tom Robinson, also happens to be the Deputy Police Chief of Reno, Nevada. The Airport is owned by the Federal Government and leased to the County, not the Munincipality of Reno. The City of Reno therefore has no jurisdiction, or right to have control over this matter.

Washoe County (where Stead Airport is located) or the Federal government (FBI, TSA, Homeland Security, Airport Police, Federal Marshalls, et al) should have been called in to arrest me and/or take me into custody. Had either entity been called in, I am informed that neither would have conducted the arrest. That's why Tom Robinson utilized his own Police Officers to arrest me...they would be in serious career trouble if they refused him. They, like many others in Reno, are afraid of him because of his Political Power, among other powers he possesses.

I appear on Monday in Reno Munincipal Court - which also does not have the authority to prosecute me - on those charges. I have filed a complaint with the Federal government to combat the problem of their violating my Civil Rights. I continue to pursue the investigations of Criminal Misconduct. I have additional Federal and State charges I will be filing to bring attention to these crimes and problems, that will be to the detriment of Air Racing's very existence if they are allowed to continue unchecked.

I do apologize since this is the easiest (and yet, still complex) way I can explain what is going on...and it's still very complex and convoluted...there is more. There is always more.

This case continues towards trial on November 15, 2004, in Reno Munincipal Court. Jurisdiction will be a major issue, not to mention First Amendement Protections and SSNS' Journalistic Investigations that are underway and being conducted in regards to Alleged and Known Criminal Misconduct by RARA and the AAWC.
